1. Short title

This Act may be cited as "Dillon’s Law".


2. Preference for States that allow trained individuals to administer epinephrine at schools

(a) In general - Section 399L(d) of the Public Health Service Act (42 U.S.C. 280g(d)) is amended—

(1) Special rule - in paragraph (1)(F)—

(A) - in the subparagraph heading, by striking "School personnel" and inserting "Trained personnel";

(B) - in the heading for clause (ii), by striking "school" and inserting "trained"; and

(C) Special rule - by adding at the end the following:

(iv) Special rule - For purposes of this subparagraph, an elementary school or secondary school in a State may treat an individual who is not an employee of the school as being part of the trained personnel of the school if—

(I) - the individual meets the requirements of paragraph (3)(E); and

(II) - the State attorney general reaffirms the certification of the State under subparagraph (G), taking into account the treatment of individuals authorized by this clause.

(2) - in paragraph (3)(E), in the matter preceding clause (i), by striking ", such as the school nurse".

(b) Epinephrine delivery systems - Section 399L(d)(3)(C) of the Public Health Service Act (42 U.S.C. 280g(d)(3)(C)) is amended by striking "auto-injectable epinephrine" and inserting "epinephrine delivery systems".

(c) Correction - Section 399L(d)(1)(F)(i) of the Public Health Service Act (42 U.S.C. 280g(d)(1)(F)(i)) is amended by striking "schoolin" and inserting "school in".
