1. Short title

This Act may be cited as the "Securing Help for Involuntary Employment Loss and Displacement Act" or the "SHIELD Act".


2. Ineligibility as a result of labor disputes

(a) Provision of State laws - Section 303(a) of the Social Security Act (42 U.S.C. 503(a)) is amended by adding at the end the following:

(13) - A requirement that, as a condition of eligibility for regular compensation for any week, an individual not be unemployed during such week as the result of a strike or other labor dispute (other than a lockout) that such individual—

(A) - is participating in,

(B) - providing financial support to, or

(C) - has a direct interest in.

(b) Federal Unemployment Tax Act amendment - Paragraph (5) of section 3304(a) of the Internal Revenue Code of 1986 is repealed.

(c) Effective date - The amendments made by this section shall apply beginning on the date that is 2 years after the date of enactment of this Act, except that nothing in this section shall be interpreted to prevent a State from amending its law before the end of the 2-year period beginning on the date of the enactment of this Act.
