1. Limitation on transfer of defense articles and defense services to Israel

1. Limitation on transfer of defense articles and defense services to Israel

(a) In general - Notwithstanding any other provision of law, the President may not sell, transfer, or authorize a license for the export of any defense article described in subsection (b) or defense services directly related to such defense articles pursuant to any authority under the Arms Export Control Act (22 U.S.C. 2751 et seq.) or the Foreign Assistance Act of 1961 (22 U.S.C. 2151 et seq.) to the Government of Israel, or to any agency or instrumentality of Israel, unless—

(1) - a law is enacted identifying the specific purpose or purposes for which such articles or services may be used for in accordance with the general purposes authorized in section 4 of the Foreign Military Sales Act (22 U.S.C. 2754); and

(2) - the Government of Israel has given written assurances satisfactory to the President that such articles and services will be used—

(A) - for the specific purposes identified in such law; and

(B) - consistent with the goals and principles described in the Arms Export Control Act (22 U.S.C. 2751 et seq.) and the Foreign Assistance Act of 1961 (22 U.S.C. 2151 et seq.), including pursuant to section 620M(c) of such Act (22 U.S.C. 2378d(c)), and in accordance with international humanitarian law, international human rights law, and relevant bilateral agreements.

(b) Defense articles described - The defense articles described in this subsection are the following:

(1) - BLU–109 bunker busting bombs.

(2) - MK80 series bomb variants.

(3) - GBU–39 small diameter bomb variants (including Increment I).

(4) - Joint Direct Attack Munition (JDAM) assemblies.

(5) - SPICE gliding bomb assemblies.

(6) - 120mm tank ammunition.

(7) - 155mm artillery ammunition, including white phosphorus munitions.
