1. Short title

This Act may be cited as the "Service Member Residence Protection Act".


2. Servicemembers Civil Relief Act: preemption of squatters’ rights

(a) Preemption - The Servicemembers Civil Relief Act (54 Stat. 1178; 50 U.S.C. 3901 et seq.) is amended by inserting, after section 301, the following new section:

301A. Preemption of squatter’s rights

Any State law establishing squatter’s rights shall not apply to premises—

(1) - owned by a servicemember; and

(2) - occupied by a squatter during a period of military service of such servicemember.

(b) Clerical amendment - The table of contents in section 1(b) of such Act (50 U.S.C. 3901(b)) is amended by inserting after the item relating to section 301 the following new item:
